Appealing a child arrangements order — routes, grounds and what an appeal can achieve

REVIEWED BY: Sean McNamara on 2026-09-01

The appeal is not a second trial

Before you appeal, understand what an appeal can do. The appeal court reviews the judge's decision for errors of law, procedure, or conclusions that were plainly wrong. It does not re-hear the evidence or give you a fresh opportunity to argue welfare. "The judge believed my ex and not me" is not, by itself, an appealable error — the judge's findings of fact carry very high respect unless truly unreasonable.

The route

  • Decisions of the Family Court (magistrates, District Judge, Circuit Judge, some High Court judges) are appealed to the Family Division of the High Court; the most serious cases go to the Court of Appeal.
  • Time limit: generally 21 days from the decision. Use Form N161 (appellant's notice), filed with the appeal court. Late applications need an extension request with a good explanation.
  • You need permission (leave) to appeal — apply to the judge at the hearing or afterwards, and renew to the appeal court if refused. See our permission-to-appeal guide for the filter in detail.

Grounds that work (and ones that do not)

Appellate courts overturn child arrangements decisions most often where:

  • The judge misapplied the welfare checklist or omitted a relevant factor entirely.
  • There was procedural unfairness — a party not allowed to respond to a key point, evidence not disclosed, or a party not given a fair chance to deal with a late allegation.
  • A finding of fact was unsupported by evidence, or an allegation central to the outcome was never properly tried.
  • The order fails to do what the judgment says — drafting errors in the order.

Grounds that rarely work: mere disagreement with the outcome, new evidence that was reasonably available before (appeal courts are reluctant to hear new evidence), and complaints about the judge's demeanour without more.

Practical sequence

1. Get the approved transcript of the judgment — you cannot mount a serious appeal without the judge's actual words. 2. Ask whether the problem is really appeal-shaped. If the arrangement has stopped working since the order, a variation or enforcement application back to the Family Court is usually faster and more effective than an appeal. 3. If appeal-shaped, file N161 with numbered grounds, within time, with the fee or an EX160 fee remission application. 4. Consider whether a s.91(14) order or costs arises from an unsuccessful appeal: hopeless appeals can carry costs consequences — take advice first.

Time matters

Orders take effect immediately, and while an appeal is pending the child lives under the appealed order unless the court suspends it. If the order requires urgent action (relocation, change of school), you can ask for the operation of the order to be stayed pending appeal — apply at the same time as your permission application.
